1. Agreement to Terms

By accessing or using the website and services provided by FiatXPay ("we," "us," or "our"), including converting cryptocurrency to fiat currency, swap services, or referral programs (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use our Services.

2. Eligibility

To be eligible to use FiatXPay, you must:

• Be at least 18 years of age (or the age of majority in your jurisdiction).
• Have the full legal capacity to enter into a binding legal agreement.
• Not be a resident or citizen of any restricted or sanctioned jurisdiction (as detailed in our AML Policy).
• Not have been previously suspended or removed from using our Services.

3. Services & Order Execution

FiatXPay provides a non-custodial gateway for selling digital assets (cryptocurrencies) in exchange for traditional currency (fiat) paid to your designated payout method, as well as digital asset swapping.

• Exchange Quotes: Exchange rates are lockable for up to 15 minutes. If a crypto deposit is not detected or confirmed within this window, the quote expires, and the transaction may be re-quoted at the current market rate or cancelled.
• Transaction Finality: All completed swap and sell orders are final and non-reversible. You are solely responsible for ensuring the accuracy of the destination bank details, mobile money number, or wallet addresses.
• Minimum Limits: The minimum transaction size for crypto-to-cash sales is equivalent to $100 USD.

4. KYC and Anti-Money Laundering (AML) Compliance

We operate in compliance with global Anti-Money Laundering (AML) and Counter-Terrorist Financing (CTF) standards. You agree to provide us with accurate, current, and complete identification information and documentation if requested by our compliance officers. We reserve the right to block transactions, hold payouts, or terminate user access if we suspect any compliance violation or fraudulent activity.

5. Fees and Rates

We charge a service fee (typically 1.0% unless customized by promotional terms or account tier) on each completed order. This fee is automatically deducted from the final payout or swap amount. We make every effort to display all fees transparently prior to order confirmation. Network transaction fees (gas/miner fees) associated with sending digital assets to our platform are borne entirely by the user.

6. Prohibited Activities

You agree not to engage in any of the following prohibited behaviors:

• Using our Services to process proceeds from illegal activities (e.g., fraud, terrorism, drug trafficking).
• Attempting to bypass security systems, exploit software errors, or perform denial-of-service attacks.
• Providing false, inaccurate, or misleading identification information.
• Using multiple accounts to circumvent transaction limits or referral rules.

7. Risk Disclosures

Trading or holding digital assets involves significant financial risk. The prices of cryptocurrencies can be highly volatile. You should carefully consider whether trading or selling digital assets is appropriate for you in light of your financial condition. FiatXPay does not provide financial, investment, legal, or tax advice.

8. Limitation of Liability

In no event shall FiatXPay, its directors, employees, or partners be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of, or inability to use, the Services, including but not limited to lost profits, service interruptions, database errors, or blockchain network congestion.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date at the top of this document. Your continued use of the Services following the posting of changes constitutes your acceptance of such modifications.
